This End User Licence Agreement (“Agreement”) is a legal contract between you (“User”, “you”) and estiMedes Ltd (“Company”, “we”, “us”, “our”), governing your use of the estimeno application, services, and related content.

By installing, registering, or using the estimeno application, you agree to be bound by the terms of this Agreement. If you do not agree, do not install, register, or use the application.

1. Licence Grant

  • estiMedes Ltd grants you a non-exclusive, non-transferable, revocable licence to use the estimeno application for personal or business purposes in accordance with this Agreement.
  • The licence does not grant ownership rights to the software or its intellectual property.

2. Eligibility

  • The application is intended only for users aged 18 years and above.
  • By using estimeno, you confirm that you meet this age requirement.
  • estiMedes Ltd does not knowingly permit minors to register or access the platform.

3. Licence Restrictions

You agree not to:

  • Share, rent, sell, or sublicense your account.
  • Reverse-engineer, decompile, or modify any part of the software.
  • Use the application to upload or distribute malware, illegal, or offensive materials.
  • Circumvent access controls or security mechanisms.
  • Use the platform for purposes that violate UK law or intellectual property rights.

Failure to comply with these restrictions may result in account suspension or termination.

4. Features and Functionality

The estimeno application includes, among others:

  • Cost estimating tools for construction projects.
  • File upload and management via the App.
  • In-app Chat/Messenger for exchanging files, images, and messages between users.
  • An interactive Map displaying Partner locations and suppliers (requires GPS access).
  • Optional paid add-on documents (Method Statement, Risk Assessment, Health & Safety Policy).
  • Integration with Partner listings and advertisements.
  • The application also includes access to the CMC loyalty programme, which allows users to earn and redeem points in connection with purchases made through estiMedes Ltd.

The terms, conditions, and redemption rules of this programme are described in the Products Document and may be changed or discontinued at any time.

estiMedes Ltd may add, modify, or remove features at any time without prior notice.

5. Data and Permissions

By using estimeno, you acknowledge and agree that:

  • The application may require access to your camera, GPS location, and push notifications to function properly.
  • Data collected through these features is handled according to the Privacy Policy.
  • estiMedes Ltd may archive logs of user activity for security and operational analysis.

6. Account Responsibility

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are accountable for all actions taken through your account.
  • Unauthorised sharing of login details may lead to account termination.

7. Ownership and Intellectual Property

  • All rights, titles, and interests in the estimeno software, content, and branding belong to estiMedes Ltd.
  • You do not acquire any ownership of the application, its source code, or its underlying data.
  • The estimeno name, logo, and interface design are protected trademarks of estiMedes Ltd.

8. Disclaimer of Warranties

  • The estimeno application is provided “as is” and “as available”, without warranties of any kind.
  • estiMedes Ltd makes no guarantees that the software will be error-free, uninterrupted, or free of defects.
  • estiMedes Ltd is not responsible for calculation errors, inaccuracies, or results produced by the application.
  • You are solely responsible for verifying the correctness of all data and outputs generated.

9. Limitation of Liability

To the fullest extent permitted by law:

  • estiMedes Ltd shall not be liable for any loss of data, profits, or business interruption resulting from use of the application.
  • We are not responsible for Partner content, map inaccuracies, or user-generated items shared via App.
  • Total liability of estiMedes Ltd, if any, shall not exceed the total fees paid by the user within the preceding 12 months.

10. Data Storage and Hosting

  • Files and uploads are stored on Cloudflare R2 servers.
  • Primary databases are hosted within the infrastructure of CyberFolks (Katowice, Poland) and are administered directly by estiMedes Ltd.
  • Data is processed and stored in compliance with the UK GDPR.

11. Termination

  • estiMedes Ltd may suspend or terminate your account if you violate this Agreement.
  • Upon termination, your licence to use estimeno will immediately cease.
  • You may voluntarily terminate your account at any time by contacting support@estimeno.com.

Termination does not affect any outstanding payment obligations or legal rights.

12. Updates and Maintenance

  • The application may automatically download and install updates.
  • By using estimeno, you consent to receiving such updates, which may include bug fixes, new features, or security patches.
  • estiMedes Ltd reserves the right to modify or discontinue the service at any time.

13. Governing Law

This Agreement is governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
